Topic: Zombie Divorces!? Omitted Assets, Newly Discovered Evidence, and Fraud, Oh My!
In 2022, the traditional principles of finality of divorces and family court orders, which had been standing for more than two decades, were challenged by two Minnesota Supreme Court cases: Bender v. Bernhard and Pooley v. Pooley. The majority of both Supreme Court opinions elevated principles of equity over the long-standing emphasis on finality and, in doing so, flipped the script on how practitioners should evaluate finality and relief under section 518.145. Abby and Seungwon will discuss the evolution of these finality principles, the history of Bender and Pooley, and the implications for family law going forward.
Speakers: Seungwon Chung and Abby Sunberg
Seungwon Chung is an associate in Taft’s Domestic Relations Group. Prior to joining Taft, Seungwon clerked for the Honorable Michael E. Burns in Hennepin County Family Court.
Abby Sunberg is a Litigation associate with experience in Commercial Litigation, Domestic Relations, and Wealth Transfer Litigation. Prior to joining Taft, Abby served as a judicial law clerk to the Honorable Timothy J. McManus in Dakota County, Minnesota. She also served as a judicial extern to the Honorable Susan Richard Nelson at the U.S. District Court, District of Minnesota.
Along with M. Boulette, Abby and Seungwon were recently part of a team of Minneapolis attorneys recognized as 2022 Attorneys of the Year by Minnesota Lawyer for their work on Pooley v. Pooley.
